• User: Any individual or entity using the Service, including landlords, property managers, and tenants.
• Content: Any data, text, images, or materials uploaded or generated through the Service.
• Account: A user account created to access the Service.

2. Overview

The Service is designed to help you manage rental properties efficiently. These Terms outline your rights and obligations, including payment terms, acceptable use, and dispute resolution. We reserve the right to update these Terms at any time, with notice provided via email or on our website.

3. Access and Security

• You are responsible for maintaining the confidentiality of your Account credentials.
• You must not share your Account with others or use someone else’s Account without permission.
• We may suspend or terminate your access if we detect unauthorized use or security breaches.
• You agree to use secure devices and connections when accessing the Service.

4. Code of Conduct

• Do not use the Service for illegal activities, including fraud or harassment.
• Do not upload malicious software or content that infringes on intellectual property rights.
• Respect other users and maintain professional communication within the Service.
• Violations may result in Account suspension or termination at our discretion.

5. Confidentiality

We treat your data as confidential and will not disclose it except as required by law or as outlined in our Privacy Policy. You agree to keep any sensitive data (e.g., tenant information) obtained through the Service confidential and use it only for its intended purpose.

6. Intellectual Property

• The Service and its content (e.g., software, logos) are owned by Kosamtech Technologies Limited and protected by copyright and trademark laws.
• You retain ownership of your Content but grant us a license to use, store, and display it to provide the Service.
• You may not reverse-engineer or distribute the Service’s software.

7. Term and Termination

• These Terms remain in effect while you use the Service or maintain an Account.
• We may terminate your Account for breach of these Terms, with 30 days’ notice unless immediate action is required.
• Upon termination, you must cease using the Service, and we may delete your data after a 30-day grace period.

8. Indemnification

You agree to indemnify and hold Kosamtech Technologies Limited harmless from any claims, damages, or losses arising from your use of the Service, including breaches of these Terms or violations of third-party rights.

9. Limitation of Liability

Kosamtech Technologies Limited is not liable for any indirect, incidental, or consequential damages resulting from your use of the Service, including data loss or downtime, to the maximum extent permitted by law. Our total liability shall not exceed the amount you paid us in the last 12 months.

11. Dispute Resolution

In the event of a dispute, we encourage amicable resolution. If unresolved, disputes will be submitted to mediation in Nairobi, Kenya, before any legal action. Any legal proceedings shall be governed by the laws of Kenya, with exclusive jurisdiction in Nairobi courts.
